The new European regulation on dual use: the complex relationship between cyber-surveillance and human rights

On 9 September 2021, the new revision of the European legislation on dual use will come into force. Among the numerous amendments updating and recasting the Regulations are measures aimed at giving the authorization process more suitable instruments treating cyber-surveillance products in the same manner as products with dual use, ensuring that their export is compatible with human rights and the emerging concept of human security.

Although the human rights do not yet have a clear legal basis for blocking or authorizing exports, the news Regulation opens up hybrid reasons for controlling the export of dual-use goods.
