The new designations have also significant consequences for European companies and financial institutions due to the extraterritorial effect of the U.S. sanctions legislation.<\/em><\/p>\n<p>On 21 November 2024, the U.S. Treasury Department&#8217;s <strong><em>Office of Foreign Assets Control <\/em><\/strong>(OFAC) announced a <strong>tightening <\/strong>of <strong>sanctions <\/strong>against <strong>Russia<\/strong>, introducing measures to further restrict the Kremlin&#8217;s ability to access the <strong>international financial system<\/strong>. This action is part of the G7 leaders&#8217; commitments to counter Russian aggression in Ukraine, specifically targeting <strong>institutions <\/strong>and <strong>individuals <\/strong>involved in providing <strong>economic and logistical support <\/strong>to the <strong>Russian war <\/strong>machine. Given the <strong>extraterritorial effectiveness <\/strong>of the U.S. sanctions legislation, the new designations also have significant <strong>consequences <\/strong>for <strong>European companies and financial institutions.<\/strong><\/p>\n<h3><strong>Designation of Gazprombank and its international subsidiaries<\/strong><\/h3>\n<p>Gazprombank, a major Russian bank, was included in the <strong>SDN-List <\/strong>along with six of its <strong>foreign subsidiaries <\/strong>located in Luxembourg, Hong Kong, Cyprus, Switzerland and South Africa. According to OFAC, Gazprombank <strong>is a crucial hub <\/strong>for Russia&#8217;s <strong>purchase <\/strong>of <strong>military equipment <\/strong>and it handles <strong>payments <\/strong>to <strong>Russian soldiers<\/strong>, including cash bonuses paid by the Ministry of Defence to encourage the recruitment of volunteers.<\/p>\n<p>Inclusion on the SDN-List, ordered pursuant to <a href=\"https:\/\/ofac.treasury.gov\/media\/57936\/download?inline\"><strong>Executive Order (E.O.) 14024<\/strong><\/a>, results in the <strong>freezing <\/strong>of all <strong>assets <\/strong>of the bank and its subsidiaries held in the United States or under the control of US persons. <strong><em>U.S.-persons <\/em><\/strong>are also <strong>prohibited from <\/strong>engaging in <strong>transactions <\/strong>with the listed entities.
